Studio Policies, Agreements & Liability Waiver

Agreement to Policies

By booking any class, party, or event with Nell’d It Paint Parties, the customer acknowledges, understands, and agrees to all policies listed on this website at the time of booking. Payment of any booking fee constitutes acceptance of these terms.

Cancellation Policy

• Cancellations made 48 hours prior to a class will receive a full refund.
• Cancellations made within 48 hours of the class will receive a store credit that may be applied to a future class.
• No-shows will not receive a refund or store credit.

Private Parties – No Shows

• No refunds or credits will be issued for guests who do not attend a private party.
• It is the responsibility of the host to ensure that all guests RSVP and attend.

Booking Fees

• All booking fees are NON-REFUNDABLE.
• Booking fees secure your date, time, and studio space and are required to hold any reservation.

Date Night Sessions

• Date Night sessions are non-refundable.
• Date Night reservations may be rescheduled one (1) time only, subject to availability.

Non-Payment Cancellations

• By booking any party, the customer agrees to pay a non-refundable booking fee.
• Final payment for private parties is due no later than two (2) days prior to the scheduled event by 5:00 PM.
• If final payment is not received by this deadline, the party will be canceled, and the booking fee will not be refunded.

Late Arrival Policy

• If you or your party arrives more than 20 minutes late, the session will need to be rescheduled.
• Most painting sessions take up to two (2) hours, and sessions will not be extended past the scheduled end time for any reason.
• Guests are encouraged to arrive at least 10 minutes early.

Weather Policy

• In the event of inclement weather, including but not limited to severe storms, unsafe driving conditions, or weather advisories, no refunds will be issued, including booking fees.
• Weather-affected events will be rescheduled for a later date, subject to availability.
• By booking and submitting payment, the customer agrees to this Weather Policy.

Photo & Media Release

By booking a party or event with Nell’d It Paint Parties, the customer grants permission for Nell’d It Paint Parties and its representatives to take photographs and/or videos during the event. These photos and videos may be used for social media, marketing, promotional materials, website content, and other business-related purposes, without compensation.

The customer confirms that he or she has the authority to grant this permission on behalf of all guests in attendance, including minors. If any guest does not wish to be photographed or recorded, it is the responsibility of the customer to notify staff prior to the start of the event.

Liability Waiver & Assumption of Risk

By booking and participating in any class, party, or event with Nell’d It Paint Parties, the customer and all participants acknowledge that participation involves the use of art materials and studio equipment and may involve inherent risks, including but not limited to:

• Paint coming into contact with skin, clothing, shoes, or personal belongings
• Accidental paint exposure to eyes or face
• Slips, trips, or minor injuries

By booking, the customer voluntarily assumes all risks associated with participation and agrees to release, waive, and hold harmless Nell’d It Paint Parties, its owners, employees, contractors, and affiliates from any liability, claims, demands, or damages arising from participation, including personal injury, property damage, or loss, except in cases of gross negligence.

Protective gear is provided when applicable, and all participants agree to follow staff safety instructions.

Nell’d It Paint Parties is not responsible for paint damage to clothing, shoes, accessories, or personal items. Participants are encouraged to dress accordingly.

By booking on behalf of minors, the customer confirms he or she is the parent or legal guardian and agrees to this waiver on behalf of the minor participant.

Drop-Off Events (Teen Nights & Youth Events)

Drop-off events, including but not limited to Teen Nights and youth sessions, are attended at the discretion of the parent or legal guardian. By registering for a drop-off event with Nell’d It Paint Parties, the customer acknowledges that the participant will attend without a parent or guardian present.

Nell’d It Paint Parties provides reasonable supervision during drop-off events; however, the business is not an insurer of participant safety. The customer understands and agrees that participation in group activities involves inherent risks and that unforeseeable events may occur.

By booking, the customer agrees to release, waive, and hold harmless Nell’d It Paint Parties, its owners, employees, and contractors from liability for injuries, losses, or damages resulting from accidents, medical emergencies, or the actions of third parties, including unforeseeable or criminal acts, except in cases of gross negligence.

The customer further confirms that the participant is physically and emotionally capable of attending a drop-off event and understands that Nell’d It Paint Parties is not responsible for personal belongings brought into the studio.
